English summary: The Spitzer Manuscript is one of the oldest Sanskrit manuscripts found on the Silk Road. The work preserved in it is unique; no further manuscripts of it have been discovered so far, nor is it transmitted in Tibetan or Chinese translations. The present volume contains an introduction which summarizes previous research and discusses grammatical, lexical and palaeographical aspects of the work, together with an outline of its content. It is followed by a complete facsimile edition of the (...) fragments accompanied by transliterations. These are supplemented by transcriptions of some fragments which are no longer available, recovered from the estate of the Indologist Dr. Moritz Spitzer. A concordance juxtaposes the earlier and present-day arrangements of the fragments, and an extensive character table documents the peculiarities of the Ku'a'a-Brahma script used in the manuscript. A complete word index and a study which aims at reconstructing the last part of the manuscript conclude the volume. As well as Buddhist scholastics the work also deals with a number of non-Buddhist topics, such as a theory of Vaise'ika qualities completely unknown from other sources it contains, inter alia, the oldest list of books of the Mahabharata and an enumeration of the sixty-four arts and sciences. The Tattvapaplavasimha is a philosophical text unique of its kind it is the only text of the Carvaka Lokayata school which has survived and the only Sanskrit work in which full-fledged scepticism is propounded. Notwithstanding that it has been hitherto almost completely ignored. The present book consists of an introduction detailed analysis edition translation with extensive notes of the first half of the text. In the introduction Jayarasi`s affiliation to the Lokayata school is reassessed and his place in (...) the historical development of Indian Philosophy evaluated. The following response first points out the obvious methodological disadvantages of Oetke’s decline to use both primary and secondary sources for his interpretation of the sadvitīyaprayoga. Oetke believes that he is able to provide an “objectively adequate” presentation of the sp and describe “the objective properties” of its content without taking the historical context into account. By divorcing meaning from context, he distorts the presumed original meaning and intention of the sp, and superimposes on it an anachronistic concern with what (...) he calls “the extrapolation principle.” The second part of the response explores the usage of the term sapakṣa as a collective term. Psychological empirical research has shown that human choice behavior often violates the assumptions of classical rational choice models. In the last few decades a new research field has emerged which aims to account for the observed choice behavior by resorting to the concepts and mathematical techniques developed in the realm of quantum physics, such as the “mental state vector” defined in a Hilbert space and the interference of quantum probability. This article is a short introduction to the quantum-like approach (...) to the description of cognitive processes. I argue that the mathematical apparatus of quantum physics can account for the observed violations of classical logic and can help develop effective models of psychological and cognitive phenomena. This is illustrated through the so-called conjunction and disjunction fallacies by providing an alternative interpretation of the results of Linda test and Hawaii test. No-fallacy configurations are made possible in the quantum-like approach by sequential modeling of mental states transitions. (shrink)

Eli Friedlander reads Rousseau's autobiography, Reveries of the Solitary Walker, as philosophy. Reading this work against Descartes's Meditations, Friedlander shows how Rousseau's memorable transformation of experience through writing opens up the possibility of affirming even the most dejected state of being and allows the emergence of the innocence of nature out of the ruins of all social attachments. In tracing the re-creation of a human subject in reverie, Friedlander is alive to the very form of the experience of reading the (...) Reveries by showing the ways this work needs to--and in effect does--generate a reader, without betraying Rousseau's utter solitude. Friedlander's book provides an afterlife for the Reveries in modern philosophy. It constitutes an alternative to the analytic tradition's revival of Rousseau, primarily through Rawls's influential vision of the social contract. It also counters the fate of Rousseau's writings in the continental tradition, determined by and large by Derrida's deconstruction. An important center in which genetic research started and was carried out in Brazil during the 20thcentury was situated at the Faculty of Philosophy, Sciences and Linguistics of the University of São Paulo, led by André Dreyfus (1897–1952). Beginning in 1943, the Ukrainian geneticist Theodosius Dobzhansky (1900–1975) visited Dreyfus’s group four times. This paper evaluates the impact of Dobzhansky’s visits on the studies of genetics and evolution developed by the members of Dreyfus’s group during the 1940s and the 1950s. The (...) study leads to the conclusion that Dobzhansky’s visits had an impact, not only in quantitative terms (the number of individual and joint publications), but also in qualitative terms. However, we also detect a decrease in the number of individual and joint publications related to the subject of the project during certain periods. The adoption of new experimental organisms by some members of the group; the involvement with subjects not related to the initial project, such as botany; Dobzhansky’s and his wife’s health problems during the third visit; and scientific disagreements between Dobzhansky and Brazilian researchers may have contributed to the decrease in publications. Franco Eugeni remembers Bruno Rizzi: in this brief introduction, I would like to remember an afternoon spent in “ Roma Tre ” with Bruno, since we were both Ordinary Professors at that University. We passed it doing a dense program of work for the next three years. At 6.00 pm, I left for “Roseto degli Abruzzi”. At six o'clock a.m. of the next morning, I still have the voice in my ears. A phone call from the Headmaster Ciro (...) d'Aniello, who told me " The Professor is dead" In that afternoon, Emilio Ambrisi and I went to Rome; we were stunned and desperate. Not many days later, a conference was held at the University of Teramo; it was the conference that we had prepared for Bruno, to celebrate his 60th birthday, but it was his memory. In the opening conference, Prof. Antonino Giambo, also fraternal friend of Bruno, burst into a tearful cry, which expressed in a moment, the senses of friendship and love that we all had for the missing friend! Starting from this work with Fabrizio Maturo, the study of some problems left open by the works of Eugeni and Rizzi will be investigated. The attribution of De vocatione omnium gentium to Prosper of Aquitaine, from the 17th century, has been the object of multiple debates, the results of whichare consolidated in the introduction to the critical edition of the tractate found in CSEL 97 (OAW 2009) in which the manuscript tradition was represented by a forked crest. The editors have considered the variae lectiones as errors, which differentiate two lines of transmission, not incorporated into the text of the edition. The variae lectiones, (...) however, according to the claims of Franco Gori, would be due, rather, to the intentional and intelligent interventions of a proofreader or an editor, perhaps by the author himself. This dissertation deals with the political uses of anger, focusing on those cases in which anger is mobilized against socially structural forms of injustice (henceforth, “radical anger”). The author provides a philosophical defence of the legitimacy and usefulness of this kind of anger, together with a set of conceptual tools for distinguishing among different instances of anger in the political realm. The text consists of seven chapters, an introduction and a short conclusion. The first chapter offers a genealogy of (...) the pathologization of radical anger, investigating the linguistic and conceptual entanglement of rage and rabies. The following chapter reviews a few cases in which oppressed groups successfully reclaimed radical anger in spite of widespread pathologizing and criminalizing tendencies, drawing mainly from the radical feminist and antiracist traditions. Special attention is also paid to the relationship between anger and violence, as well as to the opportunity for structurally discriminated groups to politically embrace anger. The metaphor of a ballistics of anger is introduced to heuristically distinguish among specific occurrences of political anger. The third chapter outlines the essential features of a political philosophy of radical anger, starting from a re-reading of Michel Foucault’s interpretation of ancient Cynicism which emphasises the angry character of the latter. After asking whether radical anger can be considered philosophically true and reactionary anger defined as untrue, three possible arguments in favour of an affirmative answer are considered. Since the first two arguments, based respectively on the works of Rahel Jaeggi and Giorgio Agamben, prove unsuccessful, a third alternative, relying mainly on the works of Foucault and Hannah Arendt, is proposed by the author. Chapters from 4 to 6 look for contemporary reprises of Cynical anger, proposing a philosophical reading of the lives and works of three figures who angrily confronted several kinds of structural injustice: Valerie Solanas, Malcolm X and Audre Lorde. The dissertation shows that each of them can offer useful additions to the political philosophy of radical anger already sketched. In particular, Solanas can help us thinking the connections between anger, negation, utopia and abolition; X testifies to the importance of the link between radical anger and the notion of care of the self (ἐπιμέλεια ἑαυτοῦ); Lorde allows us to understand the deep implications of the use of radical anger and paves the way for an erotic conception of this feeling. Finally, Chapter 7 presents the international trans-feminist movement Ni Una Menos-Non Una di Meno as an example of the practical and theoretical strengths of radical anger. (shrink)

TrivignoIn Plato's Menexenus, Socrates spends nearly the entire dialogue reciting an epitaphios logos, or funeral oration, that he claims was taught to him by Aspasia, Pericles' mistress. Three difficulties confront the interpreter of this dialogue. First, commentators have puzzled over how to understand the intention of Socrates' funeral oration (see Clavaud 1980, 17–77).1 Some insist that it is parodic, performing an (...) essentially critical function (e.g., Loraux 1986); while others claim that it is serious, in particular as an expression of Plato's political ideal (e.g., Kahn 1963).2 Adherents on both sides seem to think that the options are mutually exclusive.3 Second, commentators have had difficulty understanding why Plato would have Socrates attribute his entire oration to Aspasia (e.g., Coventry 1989, 3; Pownall 2004, 60). Most agree that this move is ironic and that it has something to do with the alleged target of the dialogue's criticism. But scholars have differed over whether the Aspasia reference is meant to implicate Pericles' funeral oration (Monoson 1998), rhetoric in general (Pownall 2004), Athens (Loraux 1986), or even Aeschines (Clavaud 1980).4 Third, scholars have struggled to make sense of the dialogue's "deliberate and fantastic anachronism" (Dodds 1990, 24). In the funeral oration, Socrates relates the history of Athens up to the King's Peace in 386 B.C., a full thirteen years after he has died. This problem has generated the least consensus, with some scholars restricting their analysis [End Page 29] to dating considerations (e.g., Dodds 1990) and at least one speculating that Socrates speaks in this dialogue as a ghost (Rosenstock 1994).5It is the contention of this article that, by understanding the rhetoric of parody in the Menexenus, one can resolve these difficulties and come to a coherent and unified understanding of the philosophical intentions of the dialogue.6 More specifically, I will show that the anachronism is a consequence of a particular parodic strategy, that of amplification; that the dialogue's parody targets not only Pericles' funeral oration in particular but funeral oratory, rhetoric, and Athens as well; and that the parody has serious philosophical implications.7 Further, I claim that the serious philosophical content is both critical and constructive. Plato subverts the civic identity and understanding of virtue encouraged by the genre of funeral oration, and he challenges its praise-based model of political discourse. At the same time, Plato's parodic criticism is not entirely negative, for it relies on alternative paradigms of civic identity, virtue, and political discourse.I. The Rhetoric of ParodyBefore turning to the Menexenus itself, I want to clarify what I mean by parody. For a working definition, I suggest that parody is "an imitation that distorts a target text, author, or genre."8 In order to make some general observations about the rhetoric of parody, I will look briefly at an exemplar of parody from Aristophanes' Frogs. I do so for three reasons: to display two strategies of parodic distortion, to show that parody can have multiple targets, and to argue that parody can have both serious and complex intentions.9In the Frogs (1331–63), Aristophanes uses at least two techniques of parodic distortion, inversion and amplification, in his extended parody of Euripides' monodies or single-actor odes.10 Parodic inversion, broadly speaking, upsets or overturns the target text by distorting the original in a way that reverses the stylistic effect or semantic intention. Parodic amplification hones in on one aspect of the target text and amplifies it to absurdity, often exposing its artificiality as a literary trope.The parodic scene features a woman who awakens, hysterical and terrified, from a god-sent dream, which has conveyed disturbing news. Video assistant referee was officially introduced into soccer regulations in 2018, after many years in which referee errors were justified as being “part of the game.” The technology’s penetration into the soccer field was accompanied by concerns and much criticism that, to a large degree, continues to be voiced with frequency. This paper argues that, despite fierce objections and extensive criticism, VAR represents an important revision in modern professional soccer, and moreover, it completes a moral revolution in the evolution of (...) the sport as a whole. Theoretically speaking, this technology enables an improvement in the sport’s professional standards and its public image and prestige, and especially its moral standards – Fair play. Furthermore, the introduction of this technology makes it possible to discover additional weaknesses (Standardization for extra time, a clear definition of a handball offense and more) that professional soccer regulations will probably be forced to address in the future. Gilles Deleuze In Part III of Hume's Dialogues concerning Natural Religion the character Demea contests the analogy drawn by Cleanthes between an orderly world and a coherent, articulate speech, stating that, When I read a volume, I enter into the mind and intention of the author: I become him, in a manner, for the instant; and have an immediate feeling and conception of those ideas, which revolved in his imagination, while employed in that composition. To begin reading Hume's Dialogues with such false and naive premises would inevitably result in a failure to pick up on all the different voices in this text. In fact, no written text can really enable a reader "to enter into the mind and intention of the author." Moreover, such a predisposition on behalf of a naive reader will become further complicated by the processes of 'distanciation' and avoidance of a central point of view, which are brought into play by Hume in this text, where religion is being considered from a purely speculative point of view. Hume has in fact given the reader a clue in the introduction as to how 221 to approach reading the Dialogues. when Pamphilus, the narrator, expounds to his friend Hermippus the advantages of presenting a discussion in the form of a dialogue rather than as a direct statement. He argues that by using a dialogue it is possible to avoid any overtones of an author addressing his reader, or a pedagogue his pupil (D 127). Confronted with a text that is paradoxically both lucid and unclear, any reader whose attitude is still limited by certain metaphysical categories might very well want to know who is actually Hume's spokesman and who he is really addressing in this discussion on the nature and existence of God. These questions are in fact related to traditional oppositions, such as that between a central and subsidiary point of view in a dialogue; between the essential and non-essential of a discussion. In his Dialogues, Hume creates a second degree of separation between himself and the characters involved in the discussion by using the literary process of 'distanciation', when he introduces the fictitious character Pamphilus, who tells Hermippus of the discussions he has heard. From this point of view the style of the text is immediately more disconcerting than Cicero's De Natura Deorum, (which inspired Hume's text), as Cicero does identify himself with his narrator, such that any effect of distanciation is far smaller. Cicero's narrator does, however, emphasize that the multiplicity of points of view in this text results in a certain degree of scepticism and suspension of judgement: "Though it is possible that they are all of them false, it is impossible that more than one of them is true" (p. 71). As Hume does in his Dialogues, Cicero here tries to avoid imposing a 222 central point of view or a single authoritative angle to his discussions, as if given by a teacher; in fact, "in a discussion of this kind our interest should be centred not on the weight of the authority but on the weight of the argument" (p. 73). Thus, wearing the mask of Pamphilus, Hume can play an ironic role, without having to give a central point of view, by having his character present the idea that "reasonable men may be allowed to differ, where no one can reasonably be positive" (D 128). These two texts therefore use the same process of disassociation from a central truth by using a supposedly neutral narrator. Each of the main chapters in her book surveys a major world religion (Hinduism, Buddhism, Judaism, Christianity, Islam, and the Chinese moral tradition) through four lenses: a brief review of the tradition; the moral world of the religion; values, principles, or virtues in the tradition; and the religious tradition on a particular moral issue (e.g., Hinduism on abortion, Buddhism on wealth and poverty, Judaism on the environment, Christianity on war and peace, Islam on men and women, and China’s one-child [End Page 202] policy). It ends somewhat abruptly with a discussion of the Shinto moral tradition.Charles Mathewes, associate professor of religious studies at the University of Virginia, has written a book that, while limited to Judaism, Christianity, and Islam, achieves much greater comparative sophistication. The text is based on a course he has taught for more than ten years called “Religious Ethics and Moral Problems,” and it bears the marks of a seasoned teacher whose primary audience is advanced undergraduate students, both religious and secular. Mathewes writes from a Protestant Christian perspective “having a strong apocalyptic dimension which is focused on the next life,” acknowledging that Roman Catholics and Eastern Orthodox may find his views “odd or confused” (53). Part 1 discusses the relationship between God and morality and provides an overview of the ethics of each of the three Abrahamic religions. Parts 2 and 3 then examine not only the moral positions but “the arguments animating the traditions” (3) on a wide range of personal and social matters (e.g., friendship, sexuality, marriage and family, lying, forgiveness, capital punishment, war, and the environment). In this book Paul Franco provides an authoritative introduction to the life and thought of Michael Oakeshott, one of the most important philosophical voices of the twentieth century. After sketching a brief biography of Oakeshott, Franco then examines his most distinctive ideas, including his early idealist theory of knowledge, his influential critique of rationalism and central social planning, and his liberal theory of civil association. Though best known as a political philosopher, Oakeshott also made significant contributions to (...) the philosophy of history, aesthetics, the philosophy of religion, and the philosophy of education. Franco highlights Oakeshott’s impressive achievements in each of these areas. This introductory piece provides context for this symposium on Richard Shusterman's new book, Philosophy and the Art of Writing. The piece reflects on the symposium genre from Plato's classic dialogue to its form today. It claims that Shusterman's work asks us to take this kind of philosophical writing more seriously, and for that reason the symposium itself has taken on a different structure. The piece discusses how each of the contributors responding to the book (with Shusterman leading the way), Eli (...) Kramer, Randall Auxier, and Charles Johnson, have engaged in practicing, nurturing, and supporting broad modes of philosophical writing, and in turn why they have chosen to do so in this context. This paper offers a new formulation of the “Hilbert's Hotel Argument” (HHA) which is superior to existing formulations because it (1) demonstrates that HH is logically impossible in the concrete world, (2) takes into account the need to consider the assumptions of HHA, and (3) offers a reply to an important objection concerning the validity of HHA. In addition, this paper contributes to the discussion by using the new HHA to defend a relevant difference between the past and the future (...) by demonstrating that the HHA applies to the former but not to the latter. Finally, this paper demonstrates the significance of metaphysical arguments such as the HHA for physical cosmology. (shrink)

Lifestyle-induced diseases are becoming a burden on healthcare, actualizing the discussion on health responsibilities. Using data from the National Association for Heart and Lung Diseases ’s 2015 Health Survey, this study examined the public’s attitudes towards personal and social health responsibility in a Norwegian population. The questionnaires covered self-reported health and lifestyle, attitudes towards personal responsibility and the authorities’ responsibility for promoting health, resource-prioritisation and socio-demographic characteristics. Block-wise multiple linear regression assessed the association between attitudes towards health responsibilities and individual (...) lifestyle, political orientation and health condition. We found a moderate support for social responsibility across political views. Respondents reporting unhealthier eating habits, smokers and physically inactive were less supportive of health promotion policies. The idea that individuals are responsible for taking care of their health was widely accepted as an abstract ideal. Yet, only a third of the respondents agreed with introducing higher co-payments for treatment of ‘self-inflicted’ conditions and levels of support were patterned by health-related behaviour and left-right political orientation. Our study suggests that a significant support for social responsibility does not exclude a strong support for personal health responsibility. However, conditional access to healthcare based on personal lifestyle is still controversial. (shrink)

A reading of Kant’s viewpoint on objectivity is suggested that finds inspiration in the second part of the third Critique, on living systems. It develops the idea that the need to articulate the distinction between objectivity and subjectivity only emerges to the extent that something resists the anticipative procedures of a living, actively engaged being. The possibility of objective knowledge, so it is argued, rests on the possibility of developing an adequate orientation in a phenomenal world, i.e., the possibility of (...) actively distinguishing an “outside” from an “inside”—this not on the basis of an a priori principle, but by taking into account the punctual resistances and disappointments that appear within contingent encounters leading to pleasure and displeasure. We consider negation as a constitutive factor in the emergence of this very basic distinction, as well as in more elaborate and complex differentiations between objectivity and subjectivity. Deepfakes are visual and audio media that use artificial intelligence to portray people saying things they never said, doing things they never did, and experiencing events that never happened. They can be trivial (“Tom Cruise knows magic tricks?”), outlandish (“Why is Nancy Pelosi drunk on national television?”), or even dangerous (“Run, the Hollywood sign is burning!”). Because deepfakes can be both persuasive and pervasive, many commentators fear that humanity will soon take another step into the post-truth abyss. -/- This Article (...) evaluates the threat deepfakes pose to truth by anticipating how they will impact the area of law most directly concerned with truth: the law of evidence. Deepfakes present an obvious challenge to the administration of justice in modern courtrooms, where audiovisual evidence plays an important role. Solutions offered in past legal scholarship—like relying on experts to identify deepfakes or criminalizing deepfake production—are superficial. They optimistically assume that deepfakes will always have a tell. To truly appreciate the threat deepfakes pose, the law must brace itself for the likely prospect of what this Article calls “deepest” fakes, which will be indistinguishable in every respect from authentic media. -/- Drawing on tools from philosophy, legal history, and technology studies, this Article demonstrates how evidence law can and likely will adapt to a world saturated with deepest fakes. Courts have long encountered the sort of philosophical skepticism that deepest fakes threaten today. In essence, the existence of deepest fakes reduces the truth value of digital media to the level of oral testimony, creative works, other easily falsifiable evidence. While deepest fakes do raise serious problems, trial procedure only needs to change if existing safeguards fail. This Article finds that deepest fakes present no different challenge for modern courts than oral testimony, paintings, and photographs presented for their early twentieth century counterparts. The safeguard then, as now, is a nuanced adversarial process that, refusing to take evidence at face value, probes each submission with contextual indicators of reliability. What emerges is an empowering picture in which human judgment, rather than blind trust in media of any sort, is the ultimate arbiter of truth. (shrink)

Discharges against medical advice (AMA) make up a significant number of hospital discharges in the United States, and often involve vulnerable patients who struggle to obtain adequate medical care. Unfortunately, much of the AMA discharge process focuses on absolving the medical center of liability for what happens to these patients once they leave the acute setting. Comparatively little attention is paid to the ethical obligations of the medical team once an informed decision to leave the acute care setting AMA has (...) been made. Via a case narrative, we offer an ethical framework that we believe can help guide an ethically defensible AMA discharge process. By emphasizing our duty to provide the best care possible under the circumstances, we contend, our ethical obligations to promote the patient's best interests can still be met despite their decision to leave the acute setting against medical advice. In this paper, we start by comparing the two agents, Ann and Bob, who are involved in two car crashes. Whereas Ann crashes her car through no fault of her own, Bob crashes as a result of reckless driving. Unlike Ann, Bob is held criminally responsible, and the insurance company refuses to cover the car’s damages. Nonetheless, Ann and Bob both receive emergency hospital treatment that a third party covers, regardless of any assessment of personal responsibility. What warrants such apparent (...) exceptionalism with respect to personal responsibility in the healthcare context? We turn our attention to an understudied aspect of the debate on personal health responsibility, namely, the conceptualisation of the person in need of emergency hospital treatment. Drawing on the research of Joshua Knobe and Shaun Nichols, we propose that a context-dependent conceptualisation of the person may help explain a reluctance to ascribe responsibility to the individual for negative health outcomes. Family accommodation refers to the attempt of family members to prevent their child’s distress related to psychopathology. Family accommodation can limit meaningful participation in personal and social routines and activities. Accommodation has been studied extensively in the context of childhood anxiety and has been linked to greater impairment, and poor intervention outcomes. Like anxiety, sensory over-responsivity symptoms are associated with heightened distress and thus, may also be accommodated by family members. The current study describes the validation of a new pediatric (...) family accommodation scale for SOR. Parents of 301 children ages 3–13 years completed an online survey, of which 48 had medical or developmental conditions. The survey included the Child Sensory Profile 2 and the newly developed family accommodation scale for sensory over-responsivity. Three Sensory Profile 2 scores were analyzed: SOR, sensory under-responsivity and sensory seeking. The FASENS consists of 18 items; 12 describing the frequency of accommodation behaviors and 6 describing the impact of the accommodation on the wellbeing of the family and the child. Results indicated that the FASENS has high internal consistency as well as a significant 3-factor confirmatory model fit: accommodations, family impact, and child impact. FASENS scores significantly correlated with SOR symptoms. However, they also correlated with under-responsivity and seeking. Parents of children with health conditions reported significantly higher FASENS scores, which corresponded with their child’s significantly higher sensory scores. Family accommodations for SOR occur to some extent in the general population, but their prevalence and impact are significantly greater when the child has a health condition, in addition to SOR. Additional research is needed to explore whether these accommodations are adaptive and whether families and children would benefit from learning to reduce them, as with anxiety. (shrink)

Background: Nurses and nursing students appear vulnerable to moral distress when faced with ethical dilemmas or decision-making in clinical practice. As a result, they may experience professional dissatisfaction and their relationships with patients, families, and colleagues may be compromised. The impact of moral distress may manifest as anger, feelings of guilt and frustration, a desire to give up the profession, loss of self-esteem, depression, and anxiety. Objectives: The purpose of this review was to describe how dilemmas and environmental, relational, and (...) organizational factors contribute to moral distress in undergraduate student nurses during their clinical experience and professional education. Research design: The research design was a systematic literature review. Method: The search produced a total of 157 articles published between 2004 and 2014. These were screened with the assessment sheet designed by Hawker and colleagues. Four articles matched the search criteria (one quantitative study and three qualitative), and these were separately read and analyzed by the researchers. The process of review and analysis of the data was supervised by a colleague experienced in moral distress who provided an independent quality check. Ethical consideration: Since this was a systematic review, no ethical approval was required. Findings: From the analysis, it emerged that inequalities and healthcare disparities, the relationship with the mentor, and students’ individual characteristics can all impact negatively on the decisions taken and the nursing care provided, generating moral distress. All these factors condition both the clinical experience and learning process, in addition to the professional development and the possible care choices of future nurses. Conclusion: Few studies dealt with moral distress in the setting of nurse education, and there is a knowledge gap related to this phenomenon. The results of this review underline the need for further research regarding interventions that can minimize moral distress in undergraduate nursing students. (shrink)

Background: Undergraduate nursing students have been documented to experience ethical distress during their clinical training and felt poorly supported in discussing the ethical issues they encountered. Research aims: This study was aimed at exploring nursing students’ perceived opportunity to discuss ethical issues that emerged during their clinical learning experience and associated factors. Research design: An Italian national cross-sectional study design was performed in 2015–2016. Participants were invited to answer a questionnaire composed of four sections regarding: (1) socio-demographic data, (2) previous (...) clinical learning experiences, (3) current clinical learning experience quality and outcomes, and (4) the opportunity to discuss ethical issues with nurses in the last clinical learning experience (from 0 – ‘never’ to 3 – ‘very much’). Participants and research context: Participants were 9607 undergraduate nursing students who were attending 95 different three-year Italian baccalaureate nursing programmes, located at 27 universities in 15 Italian regions. Ethical considerations: This study was conducted in accordance with the Human Subject Research Ethics Committee guidelines after the research protocol was approved by an ethics committee. Findings: Overall, 4707 (49%) perceived to have discussed ethical issues ‘much’ or ‘very much’; among the remaining, 3683 (38.3%) and 1217 (12.7%) students reported the perception of having discussed, respectively, ‘enough’ or ‘never’ ethical issues emerged in the clinical practice. At the multivariate logistic regression analysis explaining 38.1% of the overall variance, the factors promoting ethical discussion were mainly set at the clinical learning environment levels (i.e. increased learning opportunities, self-directed learning, safety and nursing care quality, quality of the tutorial strategies, competences learned and supervision by a clinical nurse). In contrast, being male was associated with a perception of less opportunity to discuss ethical issues. Conclusion: Nursing faculties should assess the clinical environment prerequisites of the settings as a context of student experience before deciding on their accreditation. Moreover, the nursing faculty and nurse managers should also enhance competence with regard to discussing ethical issues with students among clinical nurses by identifying factors that hinder this learning opportunity in daily practice. Technological developments in the sphere of artificial intelligence (AI) inspire debates about the implications of autonomous weapon systems (AWS), which can select and engage targets without human intervention. While increasingly more systems which could qualify as AWS, such as loitering munitions, are reportedly used in armed conflicts, the global discussion about a system of governance and international legal norms on AWS at the United Nations Convention on Certain Conventional Weapons (UN CCW) has stalled. In this article we argue for the (...) necessity to adopt legal norms on the use and development of AWS. Without a framework for global regulation, state practices in using weapon systems with AI-based and autonomous features will continue to shape the norms of warfare and affect the level and quality of human control in the use of force. By examining the practices of China, Russia, and the United States in their pursuit of AWS-related technologies and participation at the UN CCW debate, we acknowledge that their differing approaches make it challenging for states parties to reach an agreement on regulation, especially in a forum based on consensus. Nevertheless, we argue that global governance on AWS is not impossible. It will depend on the extent to which an actor or group of actors would be ready to take the lead on an alternative process outside of the CCW, inspired by the direction of travel given by previous arms control and weapons ban initiatives. Two main claims are defended in this paper: first, that typical disputes in the literature about the ontology of physical objects are merely verbal; second, that the proper way to resolve these disputes is by appealing to common sense or ordinary language. A verbal dispute is characterized not in terms of private idiolects, but in terms of different linguistic communities representing different positions. If we imagine a community that makes Chisholm's mereological essentialist assertions, and another community that makes Lewis's four-dimensionalist (...) assertions, the members of each community speak the truth in their respective languages. This follows from an application of the principle of interpretive charity to the two communities. (shrink)

Although counterproductive work behaviors can be extremely damaging to organizations and society as a whole, we do not yet fully understand the link between employees’ organizational attachment and their intention to engage in such behaviors. Based on social identity theory, we predicted a negative relationship between organizational identification and counterproductive work behaviors. We also predicted that this relationship would be moderated by ambivalent identification. We explored counterproductive work behaviors toward the organization and other individuals. Study 1, a survey of 198 (...) employees, revealed that employees who identified strongly with their organization reported lower levels of CWB-O, but as predicted, only when ambivalent identification was low. Study 2 involved a manipulation in the form of a scenario presented to 228 U.S. employees, generally replicated the findings of Study 1: the link between organizational identification and CWB-O was stronger for participants in the low ambivalence condition than for those in the high ambivalence condition. The interaction effect of ambivalent and organizational identification on CWB-I was only marginally significant in the second study. These findings provide new evidence for the positive influence of organizational identification under conditions of low ambivalence on counterproductive behaviors toward an organization. (shrink)

This article is an introduction to a philosophical approach termed “panspiritism.” The fundamental principles of this approach are summarized, with discussion of how it links to earlier (mainly Eastern) philosophical perspectives, how it differs from panpsychism and its relationship to idealism and theism. Issues such as the relationship between mind and matter, the relationship between the mind and the brain, and the emergence of mind are discussed from a “panspiritist” perspective. There is a discussion of how panspiritism relates to (...) mystical experiences. The article concludes by suggesting that this approach can help to elucidate a wide range of phenomena that appear anomalous or problematic from a materialist point of view. (shrink)

Einstein Versus Bohr is unlike other books on science written by experts for non-experts, because it presents the history of science in terms of problems, conflicts, contradictions, and arguments. Science normally "keeps a tidy workshop." Professor Sachs breaks with convention by taking us into the theoretical workshop, giving us a problem-oriented account of modern physics, an account that concentrates on underlying concepts and debate. The book contains mathematical explanations, but it is so-designed that the whole argument can be followed with (...) the math omitted. Professor Sachs' story begins with classical and nineteenth century physics, describes the early discoveries in particle theory, and introduces the "old" quantum theory, which evolved into the quantum mechanics of the Copenhagen School. Such important ideas as the Einstein Photon Box experiment and the Einstein-Podolsky-Rosen Paradox, and Schrodinger's Cat Paradox are clearly expounded, followed by a completely fresh explanation of relativity in conceptual terms, showing how apparent paradoxes can be removed by Einstein's own interpretation, especially that of his later years. Professor Sachs gives a detailed comparison of the fundamentals of the quantum and relativity theories, suggesting how the contradictions might be resolved. In an epilogue, he makes suggestions, with reference to religious notions, Taoism, and Buber's theory of I-Thou, for generalizing Einstein's approach beyond physics. (shrink)

We present a reference model for finding evidence of discrimination in datasets of historical decision records in socially sensitive tasks, including access to credit, mortgage, insurance, labor market and other benefits. We formalize the process of direct and indirect discrimination discovery in a rule-based framework, by modelling protected-by-law groups, such as minorities or disadvantaged segments, and contexts where discrimination occurs. Classification rules, extracted from the historical records, allow for unveiling contexts of unlawful discrimination, where the degree of burden over protected-by-law (...) groups is evaluated by formalizing existing norms and regulations in terms of quantitative measures. The measures are defined as functions of the contingency table of a classification rule, and their statistical significance is assessed, relying on a large body of statistical inference methods for proportions. Key legal concepts and reasonings are then used to drive the analysis on the set of classification rules, with the aim of discovering patterns of discrimination, either direct or indirect. Analyses of affirmative action, favoritism and argumentation against discrimination allegations are also modelled in the proposed framework. Finally, we present an implementation, called LP2DD, of the overall reference model that integrates induction, through data mining classification rule extraction, and deduction, through a computational logic implementation of the analytical tools. The LP2DD system is put at work on the analysis of a dataset of credit decision records. (shrink)

In this paper, I address a fundamental challenge in the philosophy of trust: how to account for trustee discretion in scenarios that fall outside explicitly defined expectations. I argue that this challenge reveals vagueness as an inherent feature of trusting relationships, often leading to disagreements between trustors and trustees. To resolve this, I propose a novel account of trust grounded in rule-following, shifting the object of trust from particular actions to adherence to rules constitutive of relationships. By focusing on relationships (...) and their constitutive rules, I provide here a framework for understanding and minimizing disagreements through communication and engaged practice. Furthermore, I argue this framework sheds light on the dynamics of trust-related reactive attitudes, in particular, distinguishing between betrayal and mere disappointment. (shrink)

In the work of both Matti Eklund and John Hawthorne there is an influential semantic argument for a maximally expansive ontology that is thought to undermine even modest forms of quantifier variance. The crucial premise of the argument holds that it is impossible for an ontologically "smaller" language to give a Tarskian semantics for an ontologically "bigger" language. After explaining the Eklund-Hawthorne argument (in section I), we show this crucial premise to be mistaken (in section II) by developing a Tarskian (...) semantics for a mereological universalist language within a mereological nihilist language (a case which we, and Eklund and Hawthorne, take as representative). After developing this semantics we step back (in section III) to discuss the philosophical motivations behind the Eklund- Hawthorne argument’s demand for a semantics. We ultimately conclude that quantifier variantists can meet any demand for a semantics that might reasonably be imposed upon them. (shrink)

The relationship between musical and linguistic skills has received particular attention in infants and school-aged children. However, very little is known about pre-schoolers. This leaves a gap in our understanding of the concurrent development of these skills during development. Moreover, attention has been focused on the effects of formal musical training, while neglecting the influence of informal musical activities at home. To address these gaps, in Study 1, 3- and 4-year-old children ( n = 40) performed novel musical tasks (perception (...) and production) adapted for young children in order to examine the link between musical skills and the development of key language capacities, namely grammar and phonological awareness. In Study 2, we investigated the influence of informal musical experience at home on musical and linguistic skills of young pre-schoolers, using the same evaluation tools. We found systematic associations between distinct musical and linguistic skills. Rhythm perception and production were the best predictors of phonological awareness, while melody perception was the best predictor of grammar acquisition, a novel association not previously observed in developmental research. These associations could not be explained by variability in general cognitive functioning, such as verbal memory and non-verbal abilities. Thus, selective music-related auditory and motor skills are likely to underpin different aspects of language development and can be dissociated in pre-schoolers. We also found that informal musical experience at home contributes to the development of grammar. An effect of musical skills on both phonological awareness and language grammar is mediated by home musical experience. These findings pave the way for the development of dedicated musical activities for pre-schoolers to support specific areas of language development. (shrink)

This article addresses some critical aspects of the relationship between aesthetic medicine (AM) and ethics and proposes a possible deontological ethical line to pursue based on current practices. The role of AM has always been controversial and suffers from unclear practical and moral boundaries, even within academic settings, since it aims to improve the appearance of individuals, not to cure a disease. Today, it is essential and pertinent to discuss these issues, as AM specialists are dealing with a growing and (...) increasingly demanding patient population that has undergone profound evolution in recent years. Current challenges within the field of AM include a lack of global uniformity concerning the education of AM specialists, an increasing number of physicians practicing AM with diverse training backgrounds, the spread of AM being practiced outside of medical practice or hospital settings, and the influence of social media where the success is modelled and dictated by the identification of a youthful appearance). By the field of action enriched by technologies that aim not only at enhancement per se but also at the preservation and regeneration of tissues, it is necessary to establish an active multidisciplinary discussion on the definition of shared ethical limits. This discussion would allow AM to fully reclaim its identity as a specialty that aims to improve patient well-being whilst maintaining respect for patient aesthetic harmony, the expertise of specialists who practice AM, the essential role of safety, and awareness of the importance of a confidential doctor−patient relationship.
